for single dad's part 1
Okay so you have filed for custody and you may or not have an attorney. this is for those without an attorney. Now since the process is long once you file for custody the mothers attorney will likely file a domestic violence protection order. Now they may or may not have ever been any domestic violence either way attorneys use this to cheat the judicial system into making a temp decision on custody. now since you filed for custody this will be the first time you and the mother are in front of the judge. do not biccer about the charges use this time to express your right to have visitations. she will likely ask for child support and custody blah blah now most states do require mediation which is a great program even though neither party has to come to an aggrement. i know that this is not very in depth but again the process is very long and i am not an attorney after i filed for custody we had mediation a month later then i waited for our trial i spent the rest of my time preparing for that day which is what i want to encourage you to do.
To Single Dads
The past few months have been very stressful for me. Besides having to choose which nation i would like citizenship in( obviously Canada is my best choice) I have more bothersome issues and that is a custody dispute. I wont go into great details but this is a small how to guide for dads that there child's mother is trying to keep your child from you. When a child is born neither parent has custody...but the mother assumes she has all rights..she is wrong. When she refuses to let you see your child be smart and spend around 200 bucks to file for custody. It will allow you to be the plaintiff and not the defendant this is good in case you go to trial. The process is long but you don't need an attorney but if your going to do it alone make sure you stay informed.
Now different states have different laws so keep that in mind. Now you have filed for custody whether you are requesting joint or sole custody it doesn't really matter because if you go to trial a judge will rule what he feels is best for the child either way.
After you file for custody you and the mother will end up going to parenting classes followed by mediation. During mediation if you two can come up with some sort of agreement then a trial is avoided. In my case we could not come up with an agreement and had to go to a parenting apart class.All of these classes generally don't help the average parent but you have to go so play nice.
Now during all this time, since you are representing yourself you need to do your homework. Keep your nose clean and avoid arguing with the mother. If you still are able to see your child save your receipts, take a lot of pictures and start to build your case. In my particular case I was able to use parental alienation to give me leverage in in my testimony. A lot of information can be found on this topic on google. The points that helped me was a daycare application in which my childs mother did not list me as the father and she listed her current boyfriend as an emergency contact, she also moved counties and hid her address and the place where my child was from me. These help but also again you need to find out the proper ways to present evidence. I had the speeding ticket of the mother doing 55 mph in a school zone with my child in the back seat but couldn't fully use it due to not presenting it correctly.
Next be prepared to have your character questioned. Women typically use claims of abuse even if it never happened to try and get sympathy from a judge, always make sure you keep the judges attention on established facts and not just her testimony. All in all this will take about a year from start to finish.
